Supreme Court to hear Kennedy vs Louisiana/Death penalty for child rapists



The U.S. Supreme Court will hear Kennedy vs Louisiana in April of this year,to determine whether it is "cruel and unusual punishment" to execute someone who is convicted of child rape.At the center of the case is Patrick Kennedy,43,who is on Louisianas' death row for the 2003 rape of his 8 year old stepdaughter,who initially lied to the police and said she had been assaulted by two boys in her garage and later recanted.He is currently the only person in the US on death row for a rape that did not include murder.While the Supreme Court banned capital punishment for rape with adult victims in 1977,five states still allow for the death penalty when the defendent has raped a child under 12.Other than Loiusiana,the other states are Montana,Oklahoma,Texas and South Carolina.The last execution of a rapist whose offense did not include murder was in 1964 and the defense is arguing,among other things,that because 90% of the men that have been executed for rape are black and Kennedy is black,that the states decision for capital punishment is "tinged with racism"

I don't care if you are black,white or purple-you victimize an innocent kid,you pay the price!I am not for or against capital punishment but if the State of Louisiana has decided child rape merits death,then who is the federal government to intervene?Louisiana State Supreme Court Justice Jeffrey Victory upheld the death sentence,saying"Our state legislature and this court have determined this category of aggravated rapist to be among those deserving of the death penalty, and short of first-degree murder, we can think of no other non-homicide crime more deserving".How many times has a child been sexually assaulted by someone whose ass was supposed to be in jail,but they were out on the street to re-offend?Too many for me!These guys cannot be rehabilitated,they have proven that themselves time and time again,and while most of them get little in the way of punishment,the victim has to live with that horror forever.If people want to get racial about something,then go out and find real racism to conquer.Pedophiles get no special consideration,whether they be black,blind,crippled or crazy!

its not that he raped a child, its the fact that he's black. Check the statistics on black people and the death penalty.

B-B-B-BULLCRAP!If you thinks its purely racial then I have a suggestion -
Put his ass in cell with several REAL black men who miss their kids and are powerless behind bars to protect them from shit like Kennedy and then tell those guys what he is there for!Talk about black unity!I am so tired of people defending scumbags who rape and kill kids,and to say he is going to be executed just because he is black is an even lamer cop-out!

I totally agree, being black has nothing to do with it, I would put the same penalty on any person whether black, white, male, female, it doesn't matter. He's just trying to get out of the death penalty.

I agree totally that these people do not deserve life.But you brought up a point that I was unaware of(90% being black) something really seems wrong there to me. considering that blacks dont make up much of the population and Im sure they're not actually 90% of the pedophiles.The show "To Catch a Predator" almost proves that. How many blacks have you seen caught on that show compared to other races.

no ther not doing it just because hes black i think its because he raped a child undre the age of 12 and if louissianna wants to make deth penilty for a child rape ict it is poible and the constitution of the united states of america provice it in amendment 10 and article 1 section 10 so plez do your reasurch before posting bogest comments im 14 yars of age and your gus comments are pathetic so take the time to get the facts strate and you will lurn more then ever before and it will move u to loisiannas side bye bye and think about it=}

For all of you that believe a pedophile should die, answer this. Why hasn't one been executed already? If you look at this case on a legal mind frame you will see that it is unpopular to execute ANYONE for a non-homicidal crime. This falls under the 8th amendment for Cruel and Unusual Punishment. Taking Kennedy off Death Row is not excusing the fact that he brutally rape his step-daughter, it's just doing what the Constitution says...or in this case, doesn't say. Why don't some of you do the research before you start making rash comments on situations like this

I am watching this case very closey as you might expect the case causes concern not only because sex offenders will get what they deserve. The case causes concern for victims who are attacked by family members people are scared that with the capital punishment on the table crimes may go unreported because the victim may say I want the person convicted but not killed.

He deserves to die for what he did to that baby. Wasn't it cruel and unusual punishment for the little girl? What about her rights? I am sick of people feeling sorry for rapists. I was molested by my stepfather from three until twelve. WE NEVER FORGET. We don't even forget with therapy

Couple of items - Kennedy brutalized this poor baby - she required massive internal injuries and can not have children
Next - someone has been executed before but it was back in the 60's
I have read both sides of this and while my heart is completely behind the death penalty my brain wonders if the rapist would just kill the child if the sentance would be the same. So as much as I hate to admit it I see both sides and that pisses me off because I would love to yell "FRY THEM!"

People should read the full court papers.

1. There was NO physical evidence or DNA linking Mr. Kennedy to the rape.

2. For 18 months immediately following the incident, the child maintained that Kennedy was NOT the rapist.

The question is not whether a rapist should be executed, but rather why Mr. Kennedy is possibly in jail for a crime he didn't commit. By the way, if he didn't commit the crime then the actual rapist is still out there, preying on other kids!
